Buying land and villas in Thailand
The land gets checked before the money moves, or it does not get checked at all.
A transfer is registered in front of a land officer under section 71 of the Land Code. Section 73 says that where the juristic act brought for registration appears void, the official is not obliged to record it. Section 74 gives that official power to interrogate the parties and summon anyone concerned to give testimony or send documents, and where there is reason to believe the registration evades the law, or that the buyer is buying on behalf of a foreigner, to ask the Minister for instructions, whose word is final. Under section 57 the title deed itself carries the holder's name and address, the location, the area and a map specifying the boundaries in four directions. All of that happens at the counter, on the day, with the money already committed. The reading is done long before.
